SAIL 2013 Best Boats Nominees

A strong lineup of new boats from domestic and foreign builders will be on display at the Newport International Boat show in September and the U.S. Sailboat Show in Annapolis in October. Bavaria Cruiser 50

It’s been on the water for a year or so in Europe, and now the Cruiser 50—big sister to the Cruiser 45 that won a 2012 Best Boats award—has made it to this side of the Pond. MARTIN BELAUNDE: ALAN GARCIA ES UN LADRON DE 4 ESQUINAS

Martín Belaunde se defiende desde Bolivia: “El tiempo me dará la razón”


Tras conocerse su paradero, el ex asesor de campaña de Ollanta Humala, Martín Belaunde Lossio ha comenzado a utilizar su cuenta en Twitter para defenderse de todo lo que se viene diciendo en torno a su caso.
En uno de sus más recientes “tuits”, Belaunde Lossio contó por qué eligió Bolivia para pedir refugio.
“El estado plurinacional de Bolivia es un Estado respetuoso de las normas internacionales. Ninguna otra razón”, escribió.
En otra publicación, el prófugo empresario dijo “estar pagando el costo de luchar por su país” pero que no se entregará fácilmente.
Sobre su relación con la pareja presidencial, Belaunde Lossio recordó que cuando se decía lo peor de Humala, él puso el pecho.
“En el 2005-2006 el grupo El Comercio decía: Humala asesino! Belaunde Lossio puso el pecho sin dudarlo. El tiempo me dio la razón. Todo era un montaje. (Ahora en el) 2014 el grupo EL Comercio dice: Belaunde Lossio corrupto, cabecilla, chuponeador! Humala responde: a ese señor lo vamos a capturar y meterlo preso”, escribió.
Luego añadió un “tuit” parafraseando a la primera Dama Nadine Heredia: “¿Tan difícil es caminar con consecuencia? El tiempo me dará la razón”.

Ley boliviana impide entrega de Martín Belaunde al Perú

Confirma analista internacional Miguel Rodríguez Mackay. El país vecino tiene que tramitar pedido de refugio sin considerar si ingresó a ese país de manera legal o ilegal, advierte.

El analista internacional Miguel Ángel Rodríguez Mackay dijo al diario UNO que el empresario Martín Belaúnde Lossio quedará en la calidad jurídica de extranjero solicitante de refugio, protegido por el Estado boliviano hasta que se resuelva su solicitud, en un plazo de 120 días. Asegura que si el pedido de refugio fuera rechazado, no será devuelto al Perú pues tiene la opción de elegir otro país para pedir o solicitar protección.
—¿Cómo funciona el refugio político en Bolivia?
—El refugio en el Estado boliviano primero es una prerrogativa no oponible, es decir tienen que resolver el pedido del solicitante que por un temor manifiesto deja su país y cruza la frontera. Para ello no importa si dejó su país de manera legal o ilegal, porque su condición de desplazamiento es sobre el temor del valor de su vida o de persecución por su credo, raza, nacionalidad, pertenencia a un grupo social o su opinión política. Una vez que hace la petición para el otorgamiento de la calidad de refugiado, se tiene que resolver mediante una entrevista.

—¿Qué pasa si es aceptado como refugiado por el Estado boliviano?
—Si el Estado boliviano, a la luz de la entrevista de dos, tres horas o más, establece que existen categorías de persecución y desplazamiento como represalia por su opinión u otra causal y su vida está en grave situación, entonces le concede la calidad de refugiado y esa calidad de refugiado no es oponible, pues nada ni nadie y ningún país, ni siquiera el país que lo busca puede efectuar una denuncia internacional contra el Estado que le concede porque es una prerrogativa del país que lo refugia.

—¿Cuánto tiempo podría permanecer en Bolivia en calidad de refugiado?
—El tiempo de permanencia como calidad de refugiado es determinado por el propio Estado y normalmente es un plazo indefinido y el que recibe el beneficio de refugio goza de los mismos derechos de un extranjero en el Estado boliviano, como la adquisición de bienes y acceso a servicios, educación y habitación, etc.

—¿Si el Estado boliviano le deniega el refugio, cuáles serán las consecuencias?
—Si el refugio es denegado, el solicitante, al carecer de prohibición, se vuelve vulnerable y por lo tanto puede recurrir a un tercer Estado para solicitar esa calidad de refugio, porque en ningún caso la denegación de refugio supone la devolución al territorio del país que lo busca.

—¿Por qué Bolivia no puede devolver a Belaúnde Lossio al Perú si le niegan el refugio?
—Porque existe el principio (internacional) de no devolución, el cual garantiza que en ningún caso pueda ser devuelto al Estado peruano.

—¿En qué casos el refugio político podría ser denegado por Bolivia?
—En ningún caso el refugio procede cuando hay de por medio la imputación objetiva de delito que se le haya señalado al perseguido. Si el solicitante tiene denuncias penales no puede ser beneficiado con el refugio y eso ya lo aclaró el canciller boliviano Choquehuanca. Hay que evitar especulaciones y esperar que Bolivia revise el expediente.

—¿Mientras tanto cuál será el papel del Estado peruano frente a esta solicitud de refugio?
—El Estado peruano tiene que proporcionar toda la información de forma y de fondo para que Bolivia cuente con los elementos de juicio completos y sólidos para que pueda considerar o no el otorgamiento facultativo y prerrogativo de darle o no el refugio.

—¿El gobierno peruano debe probar el supuesto delito por lo cual es buscado por la justicia?
—Tiene que contar con todas las pruebas porque en el refugio todo lo que se superpone a la calidad del refugio es el sentido y la naturaleza humanitaria. Si se comprueba que existen evidencias de carácter político o de opinión política del solicitante, estamos frente a una causalidad justificada para darle refugio.

—¿Qué calidad jurídica tiene en Bolivia Martín Belaúnde Lossio?
—En estos momentos tiene una sola calidad jurídica, que es de extranjero solicitante de refugio y no tiene la calidad jurídica de prófugo ni calidad jurídica de delincuente en Bolivia.

—¿Ante el pedido de solicitud de refugio está protegido por el Estado boliviano?
—El Estado boliviano, según los acuerdos internacionales y la Convención sobre el Estatuto de Refugiados de 1951 el Protocolo de 1967 y la regla y práctica latinoamericana que es muy fuerte en el derecho internacional, está en la obligación de proteger la integridad del solicitante durante todo el tiempo que demande el estudio de la determinación final de la calidad de refugiado o no.

—¿Si es negado el refugio, el Perú podría solicitar la extradición?
—Si el refugio le es negado, el Estado peruano reactivaría el aviso internacional a la Interpol para la búsqueda y detención del perseguido.

Alan: Gobierno ayudó a MBL en su fuga

El exmandatario Alan García, a través de su cuenta de Twitter, manifestó que el Gobierno, apuntando sus críticas hacia sus opositores, colaboró en la fuga del prófugo MBL a Bolivia.
“Con Locumba se facilitó el Karisma. Ahora, insultando a los opositores se facilitó la fuga a Bolivia. Es el viejo libreto del SIN de los 90″, escribió el expresidente, en alusión al levantamiento del entonces comandante, Ollanta Humala, para que Vladimiro Montesinos,a bordo del velero Karisma, se escape a Venezuela.
Por otro lado, el legislador Luis Galarreta (PPC), coincidió al afirmar “que es muy extraño que el gobierno de Bolivia, siendo amigo de Humala, no permita que se pueda traer a Belaunde Lossio”, y se le permitar andar libre cuando acá lo busca la justicia peruana.
En ese sentido, indicó que podría haber “complicidad de parte del gobierno” para dejarlo ir a un país donde ni la Interpol puede arrestarlo.

alan garcia 192El  preinforme sobre los indultos y las conmutaciones de penas otorgadas durante su gobierno a condenados por tráfico ilícito de drogas, elaborado por la Megacomisión del Congreso que preside el congresista Sergio Tejada ha encontrado responsabilidad penal en el expresidente aprista Alan García.
Se le acusa de haber perpetrado el delito de encubrimiento personal. El documento dice que “existen indicios suficientes que justifican que al expresidente de la República Alan García se le investigue por el delito de encubrimiento personal” por la liberación de miles de condenados por el delito de tráfico ilícito de drogas.
“La acción de sustraer a un condenado por tráfico ilícito de drogas, de la ejecución de la pena que le fue impuesta en juicio justo por los órganos jurisdiccionales competentes, se encuentra previsto y penado en el artículo 404.º del Código Penal. La pena privativa de libertad es no menor de tres ni mayor de seis años”, indica el documento.
Para la Megacomisión existe una exagerada cantidad de indultos y conmutaciones de penas otorgadas por García, las cuales no correspondían a un proyecto desarrollado por el Ministerio de Justicia, sino a una política del mismo Ejecutivo.
Los beneficiados fueron agentes del delito de tráfico ilícito de drogas y de robo agravado y, aunque la Constitución faculta al jefe de Estado conceder indultos y conmutar penas, esta se encuentra sujeta a “límites materiales y formales” que la misma Constitución dispone.
Se cita la lucha contra el narcotráfico, que es “un bien constitucionalizado que se encuentra taxativamente señalado en el artículo 8º de la Constitución. Este límite material no se consideró en el indiscriminado otorgamiento de Gracias Presidenciales”. El artículo 8º. de la Constitución establece que “el Estado combate y sanciona el tráfico ilícito de drogas. Asimismo, revela el uso de los tóxicos sociales”.
García transgredió lo dispuesto en los incisos 1.º y 9.º del artículo 118.º de la Constitución, que indica que “el Presidente debe cumplir y hacer cumplir las sentencias y resoluciones de los órganos jurisdiccionales”. El Presidente de la República debe hacer cumplir las sentencias dictadas por el Poder Judicial.
 “La facultad presidencial de otorgar indultos y conmutaciones de pena es un acto discrecional, excepcional y limitado. Sin embargo, se sustrajo del cumplimiento de la condena impuesta por el Poder Judicial a un promedio de tres condenados por el delito de narcotráfico y un condenado por robo agravado cada día”, reza el preinforme.
En las resoluciones supremas del gobierno aprista para conceder las miles de conmutaciones de pena “no se aprecia el desarrollo de una motivación explícita y suficiente que permita establecer las circunstancias por la que el Estado, encarnado en el Presidente de la República, otorga la gracia presidencial, circunstancia que convierte una facultad discrecional y excepcional en un acto arbitrario”.
 La Megacomisión recomienda que se debe “mantener el carácter excepcional del derecho de gracia presidencial ya que su uso indiscriminado envía un mensaje negativo a laciudadanía. No se brindó un razonamiento suficiente que permita concluir en el perdón de la pena”.
 El citado grupo de trabajo sindica al entonces presidente de la Comisión de Gracias Presidenciales, el aprista Miguel Facundo Chinguel. Un sentenciado por narcotráfico recluido en Piedras Gordas que fue entrevistado por los congresistas aseguró que durante el gobierno aprista se liberó a narcotraficantes que entregaban dinero a cambio. “Diez mil dólares por año, y yo buscaba siquiera bajarme los quince años o quedarme con los quince años, o sea me estaban hablando de ciento cincuenta mil dólares para una conmutación, dijo.
 Otros narcotraficantes reincidentes, incluso colombianos y mexicanos, pagaron el cupa y se fueron con conmutación”, denunció. Durante la gestión de Facundo Chinguel también se incrementó a 50 personas el personal que trabajaba en la Comisión de Gracias Presidenciales y se dispuso que su personal asista a los penales para recoger las solicitudes de los internos.
 “En el lapso de tiempo que Miguel Facundo Chinguel ejerce la Presidencia de la Comisión de Gracias Presidenciales, el personal que laboraba ahí fue incrementando y se dispuso que el personal visite los penales y recoja las solicitudes de los internos que solicitaban la conmutación de la pena”, dice el informe.
Se detalla que primero los expedientes se remitían al despacho viceministerial, pero luego esos documentos empezaron a llegar directamente al despacho del ministro de Justicia. García muchas veces proponía que la reducción de pena para los sentenciados fuera mayor a la que recomendaba la Comisión de Gracias Presidenciales. “La Comisión proponía (que se reduzca) de 15 a 10 años de prisión y el Presidente de la República disponía que se rebaje a 6 años”, se lee.
“Durante el gobierno de Alan García, otros narcotraficantes reincidentes, como también colombianos y mexicanos pagaron su bolsita y se fueron con conmutación”, denunció un preso entrevistado por la Megacomisión.
Durante su asistencia a la citación a la Megacomisión, Garcia se quejó de la difusión del preinforme, pero  no dijo que fuese tal, sino que se trataba de ya una virtual condena contra él.
